PROFESSIONAL ETHICS
AI in Legal Practice
Israel Bar Association · National Ethics Committee · Updated Opinion 60/24
The National Ethics Committee’s updated opinion addresses lawyers’ use of AI.
- Professional responsibility. AI may assist legal work; lawyers remain responsible for their work and must exercise independent professional judgement. Autonomous tools require effective supervision.
- Verification. Check AI-generated facts, authorities and analysis before relying on them, advising clients or presenting material to a court.
- Confidentiality and security. Assess the provider, contractual terms, account settings, access controls and use of data. Verify protections rather than relying on marketing claims.
- Client communication. Disclosure depends on the circumstances, including material effects on representation, decisions or fees. Prior informed consent is required for restricted client information in open systems where identification risks remain; consent does not override other legal duties.
- Firm governance. Adopt clear policies on AI use, train staff, control access and review providers. Human oversight and professional duties continue to apply to closed systems.
