Litigation & Dispute Resolution
A coherent case strategy, from the first contested issue to judgment or negotiated resolution.
We represent clients in insurance, tort and related civil disputes before the Israeli courts. The conduct of a case requires more than a sequence of procedural steps: the factual account, legal arguments, expert evidence and commercial objectives must support a consistent strategy. We develop that strategy early and reassess it when the evidence or the proceedings justify a change.

Defining the issues that will decide the case
We examine the pleadings, contemporaneous documents and applicable legal framework to identify the issues that require proof. Case preparation addresses the allocation of the burden of proof, disputed factual propositions and the relationship between the main claim and any third-party proceedings. Procedural applications and disclosure are considered by reference to their contribution to the overall case.
Preparing the evidential case
Witness evidence and expert opinions are assessed for consistency with the documentary record and with each other. We identify assumptions that need testing, gaps requiring clarification and technical matters that must be explained to the court. Preparation for hearings and cross-examination focuses on the propositions that materially affect liability, causation or quantum.
Negotiation and mediation
Settlement is evaluated alongside the preparation of the case. We assess the available alternatives, the range of outcomes and the implications of proposed terms, including releases, contribution and the allocation of costs where relevant. Mediation and negotiations are approached with a defined mandate and an evidence-based assessment of the client’s position.
Judgment and the next decision
Following a substantive decision, we assess its practical effect, the obligations it creates and whether further proceedings are justified. Advice on appeal or related procedural steps considers the nature of the alleged error, the applicable route and the implications of delay, costs and enforcement. Clients receive a recommendation grounded in the decision and the record of the case.
