Claims Management & Risk Assessment
Early analysis, purposeful investigation and clear reporting throughout the life of a claim.
We support insurers and businesses in evaluating and managing claims before and during litigation. Our work translates the available material into an assessment of coverage, liability and quantum, identifies the evidence still needed and sets out the decisions facing the client. The objective is a defensible course of action that can be revised as the facts develop.
- Initial risk assessment
- Investigation planning
- Reserve recommendations
- Settlement authority
An early view of exposure
Initial advice separates established facts, disputed allegations and missing information. We analyse the pleaded or anticipated claim, the relevant policy and contractual relationships and the principal drivers of damages. Where a single figure would conceal material uncertainty, we explain the assumptions and range underlying our assessment and identify what may change it.
Investigation with a defined purpose
Recommendations for documents, factual enquiries and expert input are tied to the issues that affect the outcome. We consider which evidence is time-sensitive, what must be preserved and which additional steps are proportionate to the amount and nature of the claim. This approach supports a focused investigation and avoids treating the accumulation of documents as a substitute for analysis.
Reporting at material stages
Our reports address developments such as expert appointments, receipt of opinions, court proposals and the preparation of evidence. We explain their significance for liability, quantum and the conduct of the case, and identify the instructions required. Reserve and settlement recommendations are supported by the current evidential position and the assumptions on which the assessment depends.
Resolution in its commercial context
The evaluation of settlement takes account of the legal merits, evidential risk, likely costs and the value of certainty. Where proceedings continue, the same analysis informs preparation of the defence and the allocation of effort. Lessons from the matter can also inform the client’s approach to similar claims and recurring sources of exposure.
